Janet Finch-Saunders MS/AS, Shadow Minister for Climate Change is today calling for a comprehensive appeals process to be allowed in light of concerns raised by the community on their ability to propose such appeals. The Member of the Senedd is explicit in wanting to ensure that there are options for communities to appeal decisions to approve developments.
Commenting on the matter, Janet said,
“The community wants the Local Planning Authority to act in the best interest of the youngest and most vulnerable in society, however there is no way of the community appealing the LPA’s decision to grant permission because only the person who made the application can appeal.
“We need a planning process which ensures that LPAs are not scared of refusing applications due to fear of being taken to appeal by wealthy developers who can afford costly barristers.
“At the moment it is clear that the planning system is not effective in responding to the will of the people, and that at the end of the day the odds of the community succeeding against planning and building professionals is unfortunately thin”

Heddiw, mae Janet Finch-Saunders AS, Gweinidog Newid Hinsawdd yr Wrthblaid, yn galw am broses apelio gynhwysfawr yng ngoleuni’r pryderon a fynegwyd gan y gymuned ar eu gallu i gynnig apeliadau o’r fath. Mae’r Aelod o’r Senedd yn glir ei bod am sicrhau bod opsiynau i gymunedau apelio yn erbyn penderfyniadau i gymeradwyo datblygiadau.
Wrth roi sylwadau ar y mater, dywedodd Janet:
“Mae’r gymuned am i’r Awdurdod Cynllunio Lleol weithredu er budd y bobl ieuengaf a mwyaf bregus mewn cymdeithas, ond nid oes ffordd i'r gymuned apelio yn erbyn penderfyniad yr Awdurdod i roi caniatâd gan mai dim ond y person a wnaeth y cais gaiff apelio.
“Mae angen proses gynllunio arnom sy’n sicrhau nad yw Awdurdodau Cynllunio Lleol ofn gwrthod ceisiadau gan eu bod yn pryderu am wynebu apêl gan ddatblygwyr cyfoethog a all fforddio bargyfreithwyr drud."
“Ar hyn o bryd, mae’n amlwg nad yw’r system gynllunio’n effeithiol wrth ymateb i ewyllys y bobl, ac ar ddiwedd y dydd nid oes gan y gymuned fawr o obaith o lwyddo yn erbyn gweithwyr cynllunio ac adeiladu proffesiynol.”
